FAQs

Frequently Asked Questions — Labour Law

Can I file a labour dispute if I was employed on contract or as a daily wager?

Yes. Contract workers, daily wagers and temporary employees are also entitled to labour law protections under the Industrial Disputes Act, 1947 and the Contract Labour (Regulation and Abolition) Act, 1970. The nature of employment does not bar you from seeking legal remedies — contact us to assess your specific case.
Generally, labour disputes must be raised within 3 years of the cause of action under the Limitation Act. However, some claims — such as gratuity claims — have specific time limits under their respective Acts. It is critical to act quickly to avoid losing your right to claim. Consult us immediately.
Non-deposit of PF contributions is an offence under the Employees' Provident Funds & Miscellaneous Provisions Act, 1952. You can file a complaint with the Regional PF Commissioner (RPFC), Lucknow. We handle EPFO complaints, recovery proceedings and related writ petitions before the Allahabad High Court.
Lawful termination depends on whether the employee is a "workman" under the Industrial Disputes Act and the size of your establishment. For workmen, a proper domestic enquiry following natural justice principles is mandatory. For non-workmen, contractual terms apply. We advise employers on the correct process to minimise legal risk.
Under the Industrial Disputes Act, most individual and collective disputes must first go through conciliation before the Conciliation Officer (Labour Officer). If conciliation fails, a failure report is issued and the matter can then be referred to the Labour Court or Industrial Tribunal. We guide clients through every stage of this process.
